An Architect’s Legal Perspective- Design, Enforcement, and Construction- AIA Registered 2 hr. LU/HSW

Get two hours of face-to-face instruction for Design Professionals in the legal distinctions between Design Professionals, Code Enforcement Officials, and Contractors using New York State rules and regulations as the template for this presentation.  The Course provides an introductory review of how and where New York State provides information in separate regulatory agencies on statutory rules, regulations, responsibilities, administrative procedures, and as may be applicable, regulated limitations of authority.   The objective of the course is to provide the Design Professional with a better base of knowledge in understanding their statutory roles under professional licensing regulations as well as an improved understanding of similar statutory roles of other code and construction professionals separately involved in design and construction activities.  The course also endeavors to assist the Design Professional in gaining an improved capacity to educate and counsel as an important adviser to their clients, the general public, community leaders, regulatory officials, etc.  Participants will leave the presentation with an improved understanding of both the overall value of the Design Professional’s responsibilities for the built environment as well as the regulatory statute and standards of care that define that value from a legal perspective.  The course is presented by a practicing Architect focusing on topics such as design delegation, professional seals and certifications, illegal practice, etc. that are often core concepts in legal questions related the roles of Design Professionals, Code Enforcement Officials, Contractors, Owners, etc.  This course has separate standing as an approved continuing education topic for New York State certified Code Enforcement Officers.

Learning Objectives:

Understand the basic regulations for design professionals and how they are intended to protect the Health, Safety and Welfare of both clients and the public.

Understand the basic regulations for code enforcement officials (CEO’s) and the limits of their role in ensuring the public Health, Safety, and Welfare.

Understand the basic regulations for contractors and how their role differs from design professionals and CEO’s in providing a built environment that supports the Health, Safety and Welfare of the public.

Understand some of the basic select legal concepts under New York State regulations for design and construction and how these concepts are intended to protect the public.
